Terms of service

These Terms and Conditions apply to your use of the ATOM LED Lighting website and to every order you place with ATOM LED Lighting Ltd. We care about our customers and want you to be happy with what you buy, so the following sets out the terms that apply to your order in plain, clear language.

1. Definitions

In these terms:

  • "We", "us", "our" means ATOM LED Lighting Ltd.
  • "You", "your" means the person placing the order or using the website.
  • "Website" means atomled.co.uk and any associated pages operated by us.
  • "Goods" or "products" means the items you order from us.
  • "Consumer" means an individual buying goods wholly or mainly outside their trade, business, craft or profession.
  • "Custom-cut" or "made-to-measure" goods means LED strip, LED neon flex or other products cut or made to a length or specification you have asked for.

2. Use of the Website

You may use the website for lawful purposes only. You agree not to use it in any way that breaches any applicable law or regulation, or that is fraudulent or harmful. We may change or amend the website at any time without giving you notice, but the terms and conditions that applied when you placed your order will continue to apply to that order.

We make reasonable efforts to keep the website available, but we do not guarantee it will always be available or uninterrupted.


3. Your Account and Password

If you create an account with us, you are responsible for keeping your account details and password confidential and for all activity that takes place under your account. Please tell us straight away if you believe someone has accessed your account without your permission. We may suspend or close an account if we reasonably believe these terms have been breached.


4. Our Contract with You

When you place an order, you are offering to buy the product(s) from us, and we will send you an order acknowledgement. Your order is only accepted by us once the product(s) have been dispatched to you. Until then we can decline to supply the goods. We will try to ensure this never happens, but we reserve the right not to fulfil your order for any reason — for example, if we have made an error in the price or description, or we cannot get hold of the product you need. In those circumstances we will refund any amount you have paid to us.

IP65 waterproof products are not suitable for recessed installations in the ground or in any surface. For those applications you need IP68 neon flex, which is designed for outdoor recessed use. Any unauthorised amendment or improper use of the product may void the warranty (see the warranty section below). For more information, please get in touch or email us at sales@atomled.co.uk.


5. Availability

We complete a large number of deliveries each week and rely on a stock-control system to manage availability. Occasionally that system can be wrong. If we find a product you have ordered is not available, we will tell you as soon as we know and do our best to put things right, including a full refund of any sum you have paid for goods we cannot supply.


6. Our Products

The images of the products on our website are for illustrative purposes only. Although we have made every effort to display the colours accurately, we cannot guarantee that your device's display accurately reflects the colour of the products. Your product may vary slightly from the images shown, and packaging may differ from that pictured. Where products have natural variations, these are normal; the parameters of each product's specification are clearly shown on the website and may be reviewed and amended by us from time to time.


7. Delivery

Free UK delivery applies to 97% of our products, sent by Royal Mail on a 48-hour tracked service, with no minimum order quantity. Offshore and non-mainland destinations may be subject to a delivery surcharge.

A small number of products — around 21 rigid 1-metre profiles — ship via DPD because of their length, rather than by Royal Mail. These items carry a delivery charge of £6.95 on orders under £90, and are sent free on a next-day service on orders of £90 or more. This exception applies only to those rigid 1-metre profiles.

Our delivery services are:

  • Standard delivery is sent free via Royal Mail on a 48-hour tracked service on 97% of our products.
  • Free next-day delivery is available on Mainland UK orders over £90 ordered by 1pm, Monday to Friday, sent via DPD. Order before the 1pm cut-off and your goods are dispatched the same working day; orders placed after the cut-off are dispatched the next working day.
  • International delivery is sent via FedEx, or by Royal Mail International where FedEx is not available to your destination. International delivery is charged at checkout.
  • Once goods have been delivered, they become the property and responsibility of the purchaser.
  • Any delivery issue must be reported to ATOM LED Lighting Ltd as soon as possible.
  • Lead times may extend during busy periods.

8. Things Beyond Our Control

We will not be liable or responsible for any failure to perform, or delay in performing, any of our obligations under these terms that is caused by events outside our reasonable control. Such events include any act, omission, non-occurrence or accident beyond our reasonable control, and in particular (without limitation):

  • fire, explosion, storm, flood, earthquake, subsidence, epidemic, pandemic or other natural disaster or adverse weather;
  • the impossibility of using railways, shipping, aircraft, motor transport or other means of public or private transport; or
  • the impossibility of using public or private telecommunications networks.

Our obligations under these terms are suspended for the period that such an event continues, and we will have an extension of time to perform those obligations for the duration of that period. We will take reasonable steps to bring the event to a close or to find a solution by which our obligations can be performed despite the event.


9. Your Statutory Rights (Consumer Rights Act 2015)

Nothing in these terms affects your legal rights as a consumer. Under the Consumer Rights Act 2015, goods we supply must be:

  • of satisfactory quality — meeting the standard a reasonable person would consider satisfactory;
  • fit for purpose — fit for any particular purpose you made known to us before buying; and
  • as described — matching any description, sample or model we showed you.

If goods you receive are faulty, not as described, or not of satisfactory quality, you have a short-term right to reject them within 30 days of receiving the goods for a full refund. After that period, you are entitled to a repair or replacement, and if a repair or replacement is unsuccessful, to a price reduction or a refund. These statutory rights apply to all goods we sell, including custom-cut and made-to-measure items, and are in addition to our warranty and any other rights you have under these terms.


10. Warranty and Faulty Goods

If an item develops a fault, please contact us at sales@atomled.co.uk, call 01952 370028, or fill in the form on our Contact page, and we'll arrange a repair or replacement. Our warranty runs up to 7 years depending on the product. We're not responsible for any fitting, fixture or installation costs. This does not affect your statutory rights.

The warranty covers faults arising from materials or manufacturing under normal use. It does not cover damage caused by improper installation, misuse, accidental damage, or unauthorised modification of the product. This warranty is in addition to, and does not affect, your statutory rights under the Consumer Rights Act 2015 (see the section above).


11. Returns and Your Right to Change Your Mind

Standard stock items

If you are a consumer buying online, you may change your mind and return a standard stock item within 15 days of receiving it. To qualify for a refund, the item must be unused and returned in its original condition and packaging. This is in addition to the statutory cancellation rights described below.

Custom-cut and made-to-measure items

Custom-cut, cut-to-length and made-to-measure items — including cut-to-length LED strip, cut LED neon flex and any bespoke or custom order made to your specification — cannot be returned or refunded if you simply change your mind. Because these goods are made to your specification, they are exempt from the standard cancellation right under regulation 28(1)(b) of the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. Preparing these orders takes considerable time and effort, and the cut lengths cannot be resold.

Faulty, mis-described or unsatisfactory goods — your rights are protected

The change-of-mind exclusion above applies only to returns where you have simply changed your mind. It does not affect your statutory rights. If any item — including a custom-cut or made-to-measure item — arrives faulty, not as described, or not of satisfactory quality, your rights under the Consumer Rights Act 2015 are unaffected, and you are still entitled to a repair, replacement or refund as set out in the statutory-rights section above.

Ending the contract for other reasons

If you are ending a contract for one of the reasons below, the contract will end immediately, we will refund you in full for any products not provided, and you may also be entitled to compensation. The reasons are:

  • the products do not meet the specifications shown on our website at the time of order — in this case we offer a money-back guarantee, arrange collection of the goods at our own cost, and provide a full refund;
  • we have told you about an error in the price or description of the product and you do not wish to proceed;
  • there is a risk that supply of the products may be significantly delayed because of events outside our control;
  • we have suspended supply of the products for technical reasons, or have told you we are going to do so, for a period of more than one month; or
  • you have a legal right to end the contract because of something we have done wrong.

If you are not a consumer with a right to change your mind, and we are not at fault, you may still end the contract before it is completed, but you may have to pay us reasonable compensation for the net costs we incur as a result.


12. How to End the Contract With Us

To end the contract with us, please let us know by doing one of the following:

  • Call customer services on 01952 370028 or email sales@atomled.co.uk.
  • Provide your name, address, order details and, where available, your phone number and email address, including details of what you bought, your order number, and when you ordered or received it. We suggest you call first to discuss the issue.

If you end the contract after products have been dispatched to you or you have received them, you must return them to us. You must either return the goods to us or allow us to collect them. Please call customer services on 01952 370028 or email sales@atomled.co.uk for a return label or to arrange collection.

We will pay the costs of return:

  • if the products are faulty or mis-described; or
  • if you are ending the contract because we have told you of an upcoming change to the product or these terms, an error in pricing or description, a delay in delivery due to events outside our control, or because you have a legal right to do so as a result of something we have done wrong.

If you are responsible for the costs of return and we are collecting the product from you, we will charge you the direct cost to us of collection.

If you are entitled to a refund under these terms, we will refund the price you paid for the products, including standard delivery costs, by the method you used to pay. We may make deductions from the price as described in these terms (for example, to reflect any reduction in the value of goods caused by handling them more than was necessary). We will make any refund due to you as soon as possible, and within the period required by law after the day we are told you wish to end the contract or, where goods are being returned, after we receive the goods back or you supply evidence that you have returned them.


13. Our Rights to End the Contract

We may end the contract for a product at any time by writing to you if:

  • you do not make any payment to us when it is due and you still do not make payment within a reasonable time of our reminding you that payment is due;
  • you do not, within a reasonable time of us asking for it, provide information that is necessary for us to supply the products; or
  • you do not, within a reasonable time, allow us to deliver the products to you or collect them from us.

If we end the contract in any of these situations, we will refund any money you have paid in advance for products we have not provided, but we may deduct or charge you reasonable compensation for the net costs we incur as a result.


14. Payment

You can pay using most major credit and debit cards, and by other payment methods offered at checkout. We take reasonable steps to keep your payment details secure, and using these methods does not cost you any extra. If there is a problem in receiving payment, we will let you know. If you attempt to make a payment but there is an error or delay in processing it, we may use the information you have submitted to contact you to complete your order.


15. Our Liability to You

We strive to deliver a great service to every customer, and we acknowledge that sometimes mistakes happen. Where we are responsible for a mistake, we take responsibility for it.

If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking the contract or our failing to use reasonable care and skill, but we are not responsible for any loss or damage that is not foreseeable.

The following exclusion applies to business customers only and does not apply to consumers. If you are a business customer, we are not liable to you for any loss of profit, loss of business, business interruption or loss of business opportunity. Nothing in this paragraph limits or excludes any rights or remedies you have as a consumer; if you are a consumer, your statutory rights are unaffected.

We do not exclude or limit our liability to you in any way where it would be unlawful to do so. This includes liability for:

  • death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors;
  • fraud or fraudulent misrepresentation;
  • any breach of your statutory rights as a consumer under the Consumer Rights Act 2015, including the right to receive goods that are of satisfactory quality, fit for purpose, as described, and supplied with reasonable care and skill; and
  • defective products under the Consumer Protection Act 1987.

16. Customer Reviews

Any customer reviews of the products we sell are the opinions of our customers and do not form part of the specification or description of the product. We shall not be liable if any information contained in a customer review proves inaccurate.


17. Intellectual Property

The copyright in the photographs, videos, data and text used on our website belongs to us or our suppliers, and the general look, feel and format of our website belongs to us. You are permitted to use this material only as expressly authorised by us or our suppliers. You may not copy, reproduce, republish or distribute any part of the website without our prior written permission.


18. How We Use Your Personal Information

We process your personal information in accordance with the UK GDPR and the Data Protection Act 2018. In summary, we use the personal information you provide to:

  • supply and deliver the products you have ordered;
  • process your payment for those products; and
  • where you have agreed, tell you about similar products or services we provide — you can ask us to stop this at any time.

We may share your personal information with our delivery and courier partners so that your order can be delivered, and with fraud-prevention or credit-reference agencies where necessary, who may keep a record of any search they carry out. We will not give your personal data to any other third party without your consent, except where we are required to do so by law.

Telephone calls may be recorded for training and monitoring purposes.

Full details of how we collect, use, store and protect your personal data, and the rights you have over your information, are set out in our Privacy Policy, which forms part of these terms.


19. General

If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect. Our failure to enforce any right under these terms is not a waiver of that right.

We may transfer our rights and obligations under these terms to another organisation, and we will tell you in writing if this happens; this will not affect your rights under these terms.


20. Governing Law

These terms are governed by the law of England and Wales, and any disputes arising under them are subject to the jurisdiction of the courts of England and Wales. If you are a consumer resident elsewhere in the United Kingdom, you may also bring proceedings in your local courts (in Scotland or Northern Ireland, as applicable).
